Tripplanner.nz is a directory website owned by Nection Ltd, Auckland, New Zealand. By using Tripplanner.nz (the “Website”) or publishing a listing, you (the “User”) agree to comply with and be bound by these Terms and Conditions (the “Terms”). Please read them carefully.

1. Overview

Tripplanner.nz is an online crowdsourced directory website that allows users to list and view geolocated listings. These listings are submitted by website users, including business and accommodation owners to advertise their services. Attractions can be listed for free, while accommodation and other businesses may feature their services for a monthly fee. All listings are subject to the terms and conditions outlined below. By submitting a listing on Tripplanner.nz, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Listings

2.1 Attractions: Anyone may list an attraction for free. An attraction listing may include information such as the attraction’s name, location, description, contact details, and images.

2.2 Accommodation and Business Listings: Accommodation and businesses can list their services for a fee. The fee will only be charged after the listing has been reviewed and approved by Nection Ltd. Payment will continue on a yearly basis until canceled in accordance with the cancellation provisions outlined in Section 5 below. Prices for Accommodation listings and Prices for Business Listings are linked to elsewhere on our website.

Tripplanner.nz is a directory website owned by Nection Ltd (NZBN: 9429047210868), Auckland, New Zealand. By using Tripplanner.nz (the “Website”) or submitting a listing, you (the “User”) agree to be bound by these Terms and Conditions (the “Terms”). Please read them carefully before use.

1. Overview
Tripplanner.nz is an online crowdsourced directory that allows users to submit and view geolocated listings. Listings are submitted by website users, including business and accommodation owners, to advertise their services to travellers.
Attraction listings may be submitted at no cost. Accommodation and business listings are available for a fee. All listings are subject to these Terms. By submitting a listing, you confirm that you have read, understood, and agree to be bound by these Terms.
These Terms do not limit any rights you may have under New Zealand consumer protection legislation, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

2. Listings
2.1 Attraction Listings
Any user may submit an attraction listing free of charge. A listing may include the attraction’s name, location, description, contact details, and images.
2.2 Accommodation and Business Listings
Accommodation providers and businesses may list their services for a fee. No fee will be charged until the listing has been reviewed and approved by Nection Ltd. Once approved, payment is charged on a recurring annual basis until cancelled in accordance with Section 5. Current pricing is available on the Website.
2.3 Publishing Guidelines
All listings must comply with Tripplanner.nz’s content guidelines. Nection Ltd reserves the right to decline, suspend, or remove any listing that does not meet these standards. The following rules apply to all listings:

Attraction listings must be genuinely relevant to travellers; listings of insignificant interest will be removed
You must hold all necessary rights or permissions for any images or content you publish
You must not reproduce or copy another person’s or organisation’s content, including descriptions or photographs, without permission
Images must be of reasonable quality and relevant to the listing
Links to unrelated third-party websites are not permitted
No offensive, misleading, or unlawful material is permitted

Publishing content that is false or misleading may constitute a breach of the Fair Trading Act 1986.
2.4 Links to Third-Party Websites
Approved accommodation and business listings may include one link to a third-party booking or service website. Once approved, this link may not be altered without Nection Ltd’s consent. No other third-party links are permitted within a listing.

3. Listing Publication Process
3.1 Approval
All accommodation and business listings are subject to review and approval by Nection Ltd. You will be notified of the outcome of your submission. Nection Ltd is not obliged to approve any listing.
3.2 Changes After Approval
Once a listing is approved and published, the third-party booking link (as described in clause 2.4) may not be changed without prior written approval from Nection Ltd. Other listing details may be updated via the Website’s standard editing process, subject to Nection Ltd’s review.

4. Fees and Payment
4.1 Fees
Accommodation and business listings incur an annual fee. The applicable fee is subject to GST and will be clearly disclosed to you prior to activation of your listing, in accordance with the Fair Trading Act 1986.
4.2 Direct Debit Authorisation
By activating a paid listing, you authorise Nection Ltd to collect payment by direct debit. This authorisation is subject to the terms of the direct debit authority, Gocardless Ltd, which you will be required to sign separately. Your rights under the Direct Debit scheme rules apply.
4.3 Billing Cycle
Payments will be automatically deducted on the anniversary of your listing’s initial approval date, unless you have cancelled in accordance with Section 5. You will receive reasonable advance notice before each payment is collected.

5. Cancellations and Refunds
5.1 Cancellation
You may cancel your accommodation or business listing at any time by contacting us via the Website’s contact form. Cancellation will take effect at the end of your current billing period. Your listing will remain active until that date.
5.2 Refunds
If you cancel before the end of a paid annual period, Nection Ltd will refund the unused portion of your fee, less a cancellation fee of 50% of the remaining period’s value, to cover reasonable costs incurred.
No refund will be provided for any months already elapsed in the billing period.
Where a refund is due, it will be processed within 20 working days of your cancellation request.
5.3 Consumer Guarantees
Nothing in this Section limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to your use of the Website.

6. Liability
6.1 Accuracy of Listings
Nection Ltd does not warrant the accuracy, completeness, or reliability of any listing content. Listings are provided by third-party users and are published in good faith. Nection Ltd is not responsible for errors or omissions in listing content.
6.2 Services and Attractions
Nection Ltd does not endorse, verify, or guarantee any business, accommodation, or attraction listed on the Website. Nection Ltd accepts no liability for the quality, safety, availability, or any other aspect of a listed service or attraction.
6.3 Third-Party Websites
The Website may contain links to third-party websites. Nection Ltd is not responsible for the content, accuracy, or availability of those websites. Any transactions or agreements made through third-party websites are solely between you and that third party.
6.4 Limitation of Liability
To the fullest extent permitted by New Zealand law, Nection Ltd’s total liability to any User in connection with the Website or these Terms is limited to the amount paid by that User to Nection Ltd in the 12 months preceding the relevant claim.
Nection Ltd is not liable for any indirect, consequential, or special loss or damage, including loss of revenue or loss of data, except where such liability cannot be excluded under the Consumer Guarantees Act 1993 or other applicable New Zealand law.

7. User Obligations
7.1 Accurate Information
You agree to provide accurate, complete, and truthful information in your listing. You must update your listing promptly if any details change. Publishing false or misleading information may breach the Fair Trading Act 1986.
7.2 Compliance with Laws
You agree to comply with all applicable New Zealand laws and regulations when using the Website, including but not limited to the Fair Trading Act 1986, Privacy Act 2020, and Copyright Act 1994.
7.3 Prohibited Conduct
You must not use the Website for any fraudulent, deceptive, unlawful, or harmful purpose, including spamming, impersonation, or unauthorised use of another person’s intellectual property.

8. Intellectual Property
8.1 Website Content
All content on Tripplanner.nz created by or for Nection Ltd — including text, graphics, logos, and software — is the property of Nection Ltd or its licensors and is protected under the Copyright Act 1994. You are granted a limited, non-exclusive licence to access and use the Website solely for the purpose of submitting and managing your listing in accordance with these Terms.
8.2 User-Submitted Content
You confirm that you own or have obtained all necessary rights, permissions, and licences for any content you submit to the Website, including images and written descriptions. By submitting content, you grant Nection Ltd a non-exclusive, royalty-free licence to display that content on the Website for the purpose of operating the directory.
You remain responsible for ensuring your content does not infringe any third party’s copyright or other intellectual property rights under the Copyright Act 1994.

9. Privacy
Nection Ltd collects and handles personal information in accordance with the Privacy Act 2020. For details on how we collect, use, store, and protect your personal information, and how to access or correct it, please refer to our Privacy Policy, available on the Website.

10. Modification of Terms
Nection Ltd may update these Terms from time to time. Where changes are material, we will notify you by email or via the Website at least 14 days before the changes take effect. Continued use of the Website after that date constitutes your acceptance of the updated Terms. If you do not accept the changes, you may cancel your listing in accordance with Section 5.

11. Suspension and Termination
Nection Ltd reserves the right to suspend or terminate your access to the Website, or remove any listing, if you breach these Terms or if we are required to do so by law. Where reasonably practicable, we will notify you before taking such action and give you an opportunity to remedy the breach.

12. Disputes
If you have a concern or complaint, please contact us first so we can try to resolve it. If a dispute cannot be resolved directly, either party may refer the matter to mediation or another agreed form of alternative dispute resolution before commencing court proceedings.
These Terms are governed by the laws of New Zealand. Any legal proceedings must be brought in the courts of New Zealand.
